Wir, die Universität Gießen vertreten durch ihren Präsidenten, nehmen den Schutz Ihrer persönlichen Daten sehr ernst und halten uns strikt an die Regeln der Datenschutzgesetze. Die nachfolgende Erklärung gibt Ihnen einen Überblick darüber, welche Art von personenbezogenen Daten erhoben werden, zu welchem Zweck und wie lange diese gespeichert werden.

Folgende personenbezogene Daten werden erhoben: - Einen Namen der bei dem von Ihnen gewählten Identitätsprovider hinterlegt ist, - Eine E-Mail-Adresse die bei dem von Ihnen gewählten Identitätsprovider hinterlegt ist
  3. Zweck der Datenverarbeitung
    4. Die von Ihnen angegebenen personenbezogenen Daten werden ausschließlich zur Erstellung Ihres Accounts verwendet. Über die angegebene Emailadresse informieren wir Sie über Account relevante Ereignisse und allgemeine Ereignisse des Systems (Updates, Status etc.).
  4. Rechtsgrundlage für die Datenverarbeitung
    5. Die Rechtsgrundlage für die Verarbeitung Ihrer personenbezogenen Daten zur Erstellung Ihres Accounts ist Art. 6 Abs. 1 lit. b DSGVO.
  5. Speicherdauer der Daten
    6. Ihre personenbezogenen Daten werden für die Dauer Ihres Accounts bei uns gespeichert. Wenn Sie Ihren Account löschen, werden Ihre Daten umgehend gelöscht.
  6. Ihre Rechte als betroffene Person
    7. Sie haben das Recht, Auskunft über die bei uns gespeicherten personenbezogenen Daten zu erhalten sowie das Recht auf Berichtigung, Löschung und Einschränkung der Verarbeitung Ihrer personenbezogenen Daten (Art. 15, 16 und 18 der Europäischen Datenschutzgrundverordnung). Falls Sie die Datenverarbeitung für rechtswidrig halten, können Sie Beschwerde beim Hessischen Datenschutzbeauftragten erheben (Art. 77 der Europäischen Datenschutzgrundverordnung, §55 des Hessischen Datenschutz- und Informationsfreiheitsgesetzes). Darüber hinaus sind Sie berechtigt, Ihre Einwilligung in die Datenverarbeitung zu widerrufen und die Löschung Ihrer Daten zu verlangen, wobei die bis dahin erfolgte Datenverarbeitung rechtmäßig bleibt (Art. 7 Abs. 3 und Art. 17. EU-DSGVO). Ferner können Sie verlangen, Ihre Daten in portabler Form übermittelt zu bekommen oder an einen anderen Verantwortlichen übermitteln zu lassen (Art. 20 EU-DSGVO).

Nutzungsbedingungen

Die Nutzungsbedingungen regeln die Nutzung der Qiita Jlab Plattform, im folgenden als Qiita bezeichnet, zur Speicherung von Forschungsdaten und dazugehörigen Metadaten. Der Betreiber, im folgenden als Betreiber bezeichnet, ist die Professur für Algorithmische Bioinformatik der Justus-Liebig-Universität Gießen. Die Nutzungsbedingungen sind für alle Nutzenden bindend, unabhängig davon, wie der Zugang erfolgt.
  1. Zustimmung zur Nutzung
    2. Durch die Nutzung des Qiita Services erklären Sie sich damit einverstanden, diese Nutzungsbedingungen einzuhalten und akzeptieren sie als rechtliche Vereinbarung zwischen Ihnen und dem Betreiber des Qiita Services.
  2. Nutzungsberechtigung
    3. Sie erklären und garantieren, dass Sie berechtigt sind, die Forschungsdaten und Metadaten, die Sie über diesen Webservice hochladen, zu speichern und zu nutzen. Sie tragen die alleinige Verantwortung für die von Ihnen hochgeladenen Daten.
  3. Verfügbarkeit
    4. Zur Aufgabe der Betreiber gehört unter anderem die Planung, die Bereitstellung, der Betrieb, die Wartung und die Pflege des Qiita Services. Diese Leistungen werden im Rahmen der Ausstattung insbesondere bezüglich Personal sowie Compute- und Storage Ressourcen erbracht. Es können keine Garantien bzgl. der Verfügbarkeit und Fehlerfreiheit gegeben werden. Inbesondere wird kein Service Level vereinbart.
  4. Datenschutz und Vertraulichkeit
    5. Wir verpflichten uns, die von Ihnen hochgeladenen Forschungsdaten und Metadaten vertraulich zu behandeln. Wir geben Ihre Daten nicht ohne Ihre ausdrückliche Zustimmung an Dritte weiter, es sei denn, dies ist gesetzlich vorgeschrieben oder erforderlich, um den Webservice bereitzustellen.
  5. Sicherheit
    6. Wir setzen angemessene technische und organisatorische Maßnahmen ein, um die Sicherheit Ihrer Forschungsdaten und Metadaten zu gewährleisten und unbefugten Zugriff, unbefugte Offenlegung oder Datenverlust zu verhindern.
  6. Geistiges Eigentum
    7. Sie behalten das geistige Eigentum an den von Ihnen hochgeladenen Forschungsdaten und Metadaten. Sie gewähren uns jedoch eine nicht-exklusive, weltweite Lizenz zur Nutzung, Vervielfältigung und Anzeige Ihrer Daten und Metadaten im Rahmen des Betriebs und der Bereitstellung des Qiita Services.
  7. Haftungsausschluss
    8. Wir übernehmen keine Haftung für Verluste oder Schäden, die Ihnen durch die Nutzung des Qiita Services entstehen könnten, es sei denn, diese resultieren aus grober Fahrlässigkeit oder Vorsatz seitens des Betreibers des Qiita Services.
  8. Datenlöschung
    9. Sie haben das Recht, uns aufzufordern, Ihre Forschungsdaten und Metadaten zu löschen. Wir werden Ihre Daten innerhalb einer angemessenen Frist nach Erhalt einer solchen Anfrage löschen, sofern keine rechtlichen oder berechtigten Gründe für die Aufbewahrung der Daten vorliegen.
  9. Änderungen der Nutzungsbedingungen
    10. Wir behalten uns das Recht vor, diese Nutzungsbedingungen jederzeit zu ändern. Wir werden Sie über Änderungen informieren, indem wir die überarbeiteten Bedingungen auf unserer Website veröffentlichen. Die fortgesetzte Nutzung des Webservices nach solchen Änderungen gilt als Zustimmung zu den aktualisierten Nutzungsbedingungen.

    5. The legal basis for the processing of your personal data for the creation of your account is Art. 6 para. 1 lit. b GDPR.
  5. Storage period of the data
    6. Your personal data will be stored for the duration of your account with us. If you delete your account, your data will be deleted immediately.
  6. Your rights as a data subject

You have the right to request information about the personal data stored by us as well as the right to correction, deletion and restriction of the processing of your personal data (Art. 15, 16 and 18 of the European General Data Protection Regulation). If you believe that the processing of data is unlawful, you can lodge a complaint with the Hessian Data Protection Officer (Art. 77 of the European General Data Protection Regulation, §55 of the Hessian Data Protection and Freedom of Information Act). Furthermore, you are entitled to revoke your consent to the processing of data and to request the deletion of your data, while the processing of data until then remains lawful (Art. 7 para. 3 and Art. 17. (translation, not legally binding) The Terms of Service govern the use of the Qiita Jlab Platform, hereafter referred to as Qiita, for the storage of research data and associated metadata. The operator, subsequently referred to as the Operator, is the Chair of Algorithmic Bioinformatics at Justus Liebig University Giessen. The terms of use are binding for all users, regardless of how access is provided. We, the University of Giessen represented by its President, take the protection of your personal data very seriously and strictly adhere to the rules of data protection laws.     2. By using the Qiita Service, you agree to comply with these Terms of Service and accept them as a legal agreement between you and the operator of the Qiita Service.

    3. By using the Qiita Service, you agree to comply with these Terms of Service and accept them as a legal agreement between you and the operator of the Qiita Service. You agree and warrant that you are authorized to store and use the research data and metadata that you upload through this web service. You are solely responsible for the data you upload.
  3. Availability
    4. The Operators' responsibilities include, but are not limited to, planning, providing, operating, maintaining and servicing the Qiita Service. These services are provided within the scope of the equipment, in particular with regard to personnel as well as compute and storage resources. No guarantees can be given with regard to availability and freedom from errors. In particular, no service level is agreed upon.
  4. Data protection and confidentiality
    5. We are committed to keeping the research data and metadata uploaded by you confidential. We will not share your data with third parties without your explicit consent, unless required by law or in order to be able to provide the web service.
  5. Security
    6. We have implemented appropriate technical and organizational measures to ensure the security of your research data and metadata preventing unauthorized access, disclosure, or loss of data.
  6. Intellectual Property
    7. You retain intellectual property rights in the research data and metadata you upload. However, you grant us a non-exclusive, worldwide license to use, reproduce and display your data and metadata in the course of operating and providing the Qiita Service.
  7. Liability
    8. We shall not be liable for any losses or damages that may arise from the use of the Qiita Services, unless such losses or damages result from gross negligence or intent on the part of the operator of the Qiita Services.
  8. Data Deletion
    9. You have the right to request us to delete your Research Data and Metadata. We will delete your data within a reasonable period of time after receiving such request, unless there are legal or legitimate reasons for keeping the data.
  9. Changes to Terms of Service
    10. We reserve the right to change these Terms of Service at any time. We will notify you of changes by posting the revised terms on our website. Your continued use of the Web Service following such changes will constitute your acceptance of the updated Terms of Service.
